Free Sublease Agreement Templates
A sublease or sublease agreement means to add someone new to an already existing lease. Usually, the new individual (publisher) replaces somebody who is going out (lessee or sublessor), but it can also just be a new individual being added to a leased space. A sublease is just like a normal lease except that it has a clause that allows another party to take over space if something happens.
A sublease is also a binding contract, just like a regular lease, so all the same lease rules and lease laws apply to everybody involved as with a normal lease. You should use a pre-designed template for creating a subclass agreement because it will save a lot of your time and effort. I was searching for a template and have seen some free professional sublease agreement templates on templatelab. This article will give you a few tips on creating your template for a sub-lease agreement so that you can use it to create your own legally binding agreement.
Tips for Creating a Perfect Sublease Agreement:
Tip One: Always list your relationship with the landlord. In general, the landlord must have an interest in you paying your rent, which means they must have a relationship with you. The relationship should be documented in legal terms. For example, the landlord might require that you post a notice in the common area of the property informing anyone who reads it that you are subletting the property.
Or the landlord might send you a letter notifying you that you are subletting the property in any way that they deem appropriate. Whatever the case, your relationship with the landlord is critical to your understanding of how subletting works in terms of whether you are legally bound to pay your tenant.
Tip Two: Use a roommate agreement template. Creating your template is very easy and it should be relatively inexpensive to purchase. All you need to do is visit your local office supply store and select a blank template. Then upload it onto your computer, fill out any pertinent information and print it. Your entire roommate agreement should then be completed within a matter of hours.
Tip Three and Four: Use a friend’s perspective. If you’re just moving in with someone you know, ask them to review your existing roommate agreement. Explain the contents to your friend and seek their input in regards to any aspects that seem problematic, especially those that deal with money.
Tip Five and Six: Don’t be afraid to negotiate with your landlord. Even if you signed a lease as a submitter, you have the right to request that the original tenant is removed from the property. A simple negotiable letter to your landlord may solve this problem, even if the renter has already moved out.
Tip Seven through Nine: If you’ve found a new tenant, you still have the right to ask your landlord to return your security deposit and include it in the new lease document. However, don’t expect your new tenant to do the same. Ask your landlord if you need to send a copy of the lease to your tenant to return the security deposit. Many tenants want to take care of any problems with the landlord the first time they move in, but if you’re not getting what you were expecting in return for the lease, it’s okay to shop around for a new tenant.
Tip Ten: If you’re leaving, never let the new tenant pay rent until legal papers are received and approved by the landlord. Leaving tenants in suspense will only cause problems later. Legal proceedings can delay and cost tens of thousands of dollars. Always pay rent on time and leave your legal status in the hands of a competent attorney.
Know when to ask for your security deposit. Most landlords have a default policy, which means the security deposit is automatically forfeited if the new tenant fails to pay rent. Never take the security deposit for granted. Every month you get paid, you should be returning it in full along with any late charges or interest. If you find yourself in this situation, consult a lawyer right away.
